The first year of federal service is often described as a period with no rights at all. That is wrong, and the misconception costs people their cases. Virginia federal employee law gives probationary workers narrower appeal rights than tenured employees, not zero rights, and several of the avenues that remain are among the strongest in the entire federal system. The trouble is that they run on short clocks, and an employee who spends three weeks waiting for HR to explain the termination has usually already lost one of them.
How long is the federal probationary period?
One year for most initial appointments to competitive service positions, under 5 C.F.R. § 315.801. Excepted service appointments frequently carry a trial period instead, and the length varies by authority, with two years being common. Supervisors and managers serve a separate probationary period for the supervisory role under 5 U.S.C. § 3321, and an employee who does not complete that one is returned to a non-supervisory position rather than separated.
Prior federal service can count toward probation. Under 5 C.F.R. § 315.802(b), service in the same agency, in the same line of work, without a break in service exceeding 30 days is creditable. Employees who transferred from a term appointment or came back after a short break sometimes have far less probation left than their onboarding paperwork suggests.
Can a probationary employee appeal a termination to the MSPB?
Only on limited grounds. Under 5 C.F.R. § 315.806, a probationer may appeal a termination to the Merit Systems Protection Board if the action was based on partisan political reasons or marital status, or if the agency terminated the employee for conditions arising before the appointment without following the procedures in 5 C.F.R. § 315.805.
That second ground matters more than it sounds. Section 315.805 requires advance written notice, a stated reason, an opportunity to reply, and a written decision. Terminations under 5 C.F.R. § 315.804, meaning those based on performance or conduct during the probationary period, require only written notice stating the agency’s conclusions about the inadequacy and the effective date. Agencies sometimes cite conduct that predates the appointment, such as a background investigation result or an application misstatement, while processing the action under 804. When the real basis is pre-appointment, the employee was entitled to 805 procedures, and the failure to provide them is appealable. The filing deadline is generally 30 days.
There is a further wrinkle that catches even experienced HR staff. The statutory definition of “employee” with full adverse action appeal rights at 5 U.S.C. § 7511(a)(1)(A) turns on completing one year of current continuous service, which is a separate test from the regulatory probationary period. The Federal Circuit addressed this distinction in Van Wersch v. Department of Health and Human Services, 197 F.3d 1144 (Fed. Cir. 1999), and again in McCormick v. Department of the Air Force, 307 F.3d 1339 (Fed. Cir. 2002). An employee whose probation was extended or restarted may have accrued statutory appeal rights anyway. That question is worth checking before anyone concludes an appeal is barred.
What rights does Virginia federal employee law preserve outside the MSPB?
Probationary status does not limit discrimination or whistleblower protections at all. These are the routes that carry the most weight for first-year employees.
EEO complaints
Title VII, the Rehabilitation Act, the ADEA, and GINA apply to probationers on the same terms as everyone else. The critical step is contacting an EEO counselor within 45 days of the effective date of the action, per 29 C.F.R. § 1614.105(a)(1). Miss that window and the claim is generally dismissed on timeliness regardless of merit. Reasonable accommodation obligations also apply during probation, which means an agency that separated a probationer after ignoring an accommodation request has a problem.
Whistleblower reprisal and IRA appeals
Probationers are covered by the Whistleblower Protection Act at 5 U.S.C. § 2302(b)(8). The route is a complaint to the Office of Special Counsel, followed by an Individual Right of Action appeal to the MSPB under 5 U.S.C. § 1221 once OSC exhaustion is complete, which occurs 60 days after OSC notifies the complainant it is closing the matter or 120 days after filing if OSC has not made a determination. An IRA appeal gives a probationary employee a merits hearing that a direct removal appeal would not.
USERRA claims for Guard and Reserve members are similarly unaffected by probationary status, which is relevant given how many Virginia federal positions are filled by service members and veterans.
Where do Virginia federal employees bring these claims?
Federal employees in Virginia proceed under federal statutes and regulations, not Virginia employment statutes, so the Commonwealth’s at-will doctrine has no bearing on the outcome. MSPB appeals go to the regional office serving the duty station, whether that is a civilian position at the Pentagon, Fort Belvoir, Quantico, Naval Station Norfolk, Langley, or a VA medical center. EEO complaints stay inside the employing agency until a hearing request or final agency decision. Probationary terminations drew heavy scrutiny and litigation across agencies beginning in 2025, and the procedural landscape has shifted more than once since. Anyone separated recently should confirm the current posture rather than relying on older guidance.
